
The High Court has issued a conservatory order restraining the government from implementing fare hikes for people seeking various government services.
In a gazette notification dated November 6, 2023, the government announced a review of fees for services such as replacing national identity cards, applying for passports, birth certificates, and death certificates.

However, Justice Lawrence Mugambi suspended the review pending the hearing and determination of the issues raised by Dr Magale Gikeni.
“Pending the hearing and determination of this application between the parties, authorizing the increase or review of the Official Gazette Notification dated 6 November 2023 and/or the fees/fees/surcharges specified therein; An Order of the Conservatory suspending all other documents for the purpose of this is hereby issued and hereby issued,” part of the judgment read.
Justice Mugambi further directed that the application and petition be served within three days and a response filed and served within seven days from the date of service.
“If necessary, the applicant/complainant may file a reconsideration/additional affidavit within three days from the date of receipt of the response,” Mugambi ruled.
The respondents in the case are Minister of Finance Njuguna Ndunwu, Minister of Interior Kihle Kindiki, the National Assembly and the Attorney General.
